தமிழர்களுக்கு எதிரான போரின் போது, சிறீ லங்காவின் அரச இராணுவ அமைப்புக்களினால் நிகழ்த்தப்பட்ட குற்றங்கள் அடங்கலாக பல விடயங்களை உள்ளடக்கிய, அமெரிக்கா முன் மொழிந்த பிரேரணை இன்று ஐநா மனித உரிமைப் பேரவையில் நிறைவேற்றப் பட்டுள்ளது.
சிறீ லங்காவில் போரின் போது நிகழ்ந்த குற்றங்கள் தொடர்பாக நாடு கடந்த தமிழீழ அரசாங்கம் உறுதியான ஒரு நிலைப்பாட்டையே எடுத்து வந்துள்ளது. அதாவது, குற்றம் இழைத்தவர்களைக் கண்டறிந்து பாதிக்கப்பட்ட தமிழ் மக்களுக்கு நீதி கிடைப்பதற்கு சுதந்திரமான ஒரு அனைத்துலக விசாரணை அவசியம் என்பதே எம் நிலைப் பாடாகும்.
இன்று நிறை வேற்றப் பட்டுள்ள பிரேரணையானது அமெரிக்காவினால் முன்னர் குறிப்பிடப் பட்ட சுயாதீனவிசாரணை என்பதனைத் தரமிறக்கியதோடு படிப்பினைக்கும் நல்லிணக்கத்துக்குமான ஆணைக்குழுவின் பரிந்துரைகளை நிறைவேற்றல் வேண்டும் எனும் வகையில் அமைந்துள்ளது.
போரின் போது சிறீ லங்கா அரசாங்கமும் அதன் அரசபடைகளும் தமிழ் மக்களுக்கு எதிராக, அதிலும் குறிப்பாக குழந்தைகள்;,பெண்கள், வயோதிபர், நோயாளிகள் அடங்கலாக ஆயிரம் ஆயிரம் அப்பாவி மக்களைக் கொன்று குவித்ததைப் பாராட்டிய உலக சமூகம், இன்று ஆறுதலாகவும் தீர்க்கமாகவும் ஆராய்ந்து நல்லதோர் நிலைப் பாட்டை எடுத்து, சிறி லங்கா அரசாங்கமும் தான் இழைத்த குற்றங்கள் பற்றி மீளாய்வு செய்வதற்கு ஒரு சந்தர்ப்பர்த்தை வழங்குவதற்கு முன் வந்துள்ளமை வரவேற்கத் தக்கதாகும்.
2009ஆம் ஆண்டின் முற்பகுதியில் சிறீ லங்கா இழைத்த கொடுமைகளோடு ஒப்பிடுகின்ற போது, இத் தீர்மானம் வலுவிழந்த ஒன்று என்ற போதிலும், இத் தீர்மானத்தை முறியடிப்பதற்காக சிறீ லங்கா அரசாங்கம் தன்னாலான அனைத்து முயற்சிகளையும் மேற்கொண்டது என்பதும் இங்கு கவனிக்கப் பாலது.
எது எவ்வாறாயினும், இந்தப் பிரேரணையின் தாற்பரியங்களைக் காட்டிலும் சிறீ லங்கா அரசாங்கம் தோற்கடிக்கப்பட்டுள்ளது என்பதே இங்கு முக்கியமானது. சிறீ லங்காவுக்கு இது முதலாவது தோல்வி என்பது மட்டுமல்ல இத்தகைய பல்வேறு தோல்விகள் இன்னும் வர உள்ளன என்பதே நாம் உரத்த குரலில் கூறும் செய்தியாகும்.
அனைத்துலக சமூகம் மிக விழிப்புடன் செயற்பட்டு,
சிறீ லங்கா அரசின் நெகிழ்வற்ற தன்மையைப் புரிந்து கொண்டு, அங்கு நிகழ்பவற்றை நன்கு அவதானித்து வருதல் அவசியமாகும். பாதிக்கப்பட்ட தமிழ் மக்களுக்கு நீதி வழங்குதல் தொடர்பாக, அநியாயங்களுக்குப் பொறுப்பானவர்களைக் கண்டறிந்து நீதி நிலை நாட்டப் படல் வேண்டும்.
சிறீ லங்கா அரசின் நெகிழ்வற்ற தன்மையைப் புரிந்து கொண்டு, அங்கு நிகழ்பவற்றை நன்கு அவதானித்து வருதல் அவசியமாகும். பாதிக்கப்பட்ட தமிழ் மக்களுக்கு நீதி வழங்குதல் தொடர்பாக, அநியாயங்களுக்குப் பொறுப்பானவர்களைக் கண்டறிந்து நீதி நிலை நாட்டப் படல் வேண்டும்.
அனைத்துலக மட்டத்தில் தமிழ் மக்களுக்கு நீதி கிடைத்தல் வேண்டும் எனும் சீரிய நோக்குடன் செயற்பட்டுவரும் அனைத்து குடிசார் அமைப்புகளுக்கும், ஊடகங்களுக்கும் நாம் தமிழ் மக்கள் சார்பில் எங்கள் மனமார்ந்த நன்றியறிதலை இவ்வேளையில் தெரிவிக்கின்றோம். தாய்த் தமிழகத்தின் தொப்புள் குடி உறவுகளுக்கும், அரசியல் பிணைப்புகளைக் கடந்து செயல் பட்டு வரும் அனைத்து அன்பு உள்ளங்களுக்கும் எமது நன்றிகள்.
தமிழகத்து உறவுகள் மாண்புமிகு முதலமைச்சர் செல்வி ஜெயலலிதா அவர்களின் தீர்க்கமான தலைமையில் கீழ் நல்லதோர் நிலைப் பாட்டை உலகுக்குக் காட்டி நிற்கின்றார்கள். அதாவது, தமிழீழ மக்களுக்கான போராட்டம் இப்பொழுது தமிழீழ மக்களால் மட்டுமன்றி, உலகில் வாழும் அனைத்துத் தமிழர்களாலும் முன்னெடுக்கப் பட்டு வருகின்றது என்பதே அந்த நிலைப்பாடாகும். நீதியின் அடிப்படையிலும் உன்னதமான கோட்பாடுகளின் படியும் ஆறு கோடி தமிழ் மக்களால் முன்னெடுக்கப்படும் இப் போராட்டம் வீண் போகாது.

எமக்குக் கிடைத்துள்ள இந்த அரிய சந்தர்ப்பத்தைத் தவற விடாது புலம் பெயர் தமிழ் சமூகமும், குடிசார் அமைப்புக்களும், தாயகத்திலுள்ள அரசியல் தலைமையும் கடந்த பல வாரங்களாக அயராது, ஒத்த நோக்குடன் செயல் பட்டு வந்துள்ளன. நாம் எதிர் காலங்களிலும் இத்தகைய ஒருங்கிணைந்த செயற்பாடுகளையே விரும்பி நிற்கின்றோம்.
எமக்குக் கிடைத்துள்ள இந்த அரிய சந்தர்ப்பத்தைத் தவற விடாது புலம் பெயர் தமிழ் சமூகமும், குடிசார் அமைப்புக்களும், தாயகத்திலுள்ள அரசியல் தலைமையும் கடந்த பல வாரங்களாக அயராது, ஒத்த நோக்குடன் செயல் பட்டு வந்துள்ளன. நாம் எதிர் காலங்களிலும் இத்தகைய ஒருங்கிணைந்த செயற்பாடுகளையே விரும்பி நிற்கின்றோம்.
எனவே, நாம் எமது பொது இலக்காகிய சுதந்திர தமிழ் ஈழம் எனும் இலக்கை அடைவதற்காக ஒன்றிணைந்து, கலந்துரையாடி, திட்டங்களை வகுத்துச் செயற்படல் வேண்டுமென அனைத்துதமிழ் அமைப்புக்களுக்கும் அழைப்பு விடுக்கின்றோம்.
லிபியா நாட்டில் நிகழ்ந்த கொடுமைகளின் உச்சக் கட்டத்தில் அந்தக் குற்றங்களை இழைத்தவர்களை நீதி மன்றில் விசாரணைக்குட் படுத்தல் வேண்டும் எனும் கோரிக்கை உடனடியாகவே முன் வைக்கப் பட்டது என்பதை இங்கு சுட்டிக் காட்ட விரும்புகின்றோம். சிரியாவிலும் தற்போது இத்தகைய நிலையே உள்ளது. அங்கும் மனித உரிமை மீறல்களுக்குப் பொறுப்பானவர்களைக் கண்டறிதல் வேண்டும் எனும் குரல்கள் எழுந்துள்ளன.
மனித உரிமையின் அடிப்படைக் கோட்பாடாகிய, எல்லா மக்களும் ஒரேவிதமான பாதுகாப்புக்கு உரித்துள்ளவர்கள் என்பதும், எல்லா உயிர்களும் சமமானவை என்பதும் அரசியல் தேவைகளுக்காக தடம் புரட்டப்படாமல் எப்பொழுதுமே ஏற்றுக் கொள்ளப்பட வேண்டிய தார்மீகக் கோட்பாடுகளாகும்.
சிறீ லங்காவில் தமிழர்களுக்கு இழைக்கப்பட்ட இன அழிப்பு, சிறீ லங்கா அரசினால் இன்றும் தொடர்ந்து இழைக்கப்பட்டு வரும் திட்டமிட்ட அடக்கு முறைகள் என்பவற்றுடன் ஒப்பிடும் பொழுது, லிபியாவிலும் சிரியாவிலும் நடந்துள்ள, நடைபெறும் கொடுமைகள் மிகவும் சிறிய அளவிலானவையே. இந்தக் காரணிகளின் அடிப்படையிலும், ஐநா செயலாளர் நாயகத்தினால் நியமிக்கப்பட்ட நிபுணர் குழுவினால் சுட்டிக் காட்டப்பட்டது போன்று சிறீ லங்காவுக்கு சுயாதீன விசாரணை பற்றிய அரசியல் முனைப்பு இல்லாத காரணத்தினாலும் தான் மனித உரிமைப் பேரவையில் நிறைவேற்றப் பட்ட தீர்மானம் பற்றாக்குறை கொண்டது என்பது நாடுகடந்த தமிழீழ அரசாங்கத்தின் கருத்தாக அமைகிறது.
எனவே, அனைத்துலக விசாரணையை வற்புறுத்தும் நோக்குடன் நாங்கள் அனைத்துலக மட்டத்திலும், தேசங்களின் மட்டங்களிலும் கலந்துரையாடல்களை நடாத்தத் திட்டமிட்டுள்ளோம்.
நாடுகடந்த தமிழீழ அரசாங்கம் 2012ஆம் ஆண்டினை அனைத்துலக விசாரணைக்கான ஆண்டாக ஏற்கனவே பிரகடனப் படுத்தியுள்ளது.
வேறு நாடுகளில் பல்நாட்டு, உள்நாட்டு மட்டத்திலான கூட்டங்களை நடாத்தி அனைத்துலக விசாரணையைக் கோரவுள்ளோம்.
அத்துடன், நாடுகடந்த தமிழீழ அரசாங்கத்தின் பேரவையில் இலங்கைத் தீவில் உள்ள எமது உடன் பிறப்புக்களின் பாதுகாப்பை உறுதி செய்யும் ஒரு பொறி முறையினை உருவாக்கக் கோரும் பிரேரணை ஒன்றையும் நிறைவேற்றியுள்ளோம். நாங்கள் உலகிலுள்ள வௌ;வேறு பாதுகாப்புப் பொறி முறைகள் பற்றியும் ஆராய்ந்து வருகின்றோம்.
2009ஆம் ஆண்டில் சிறீ லங்காவில் நடைபெற்றது போர்க்குற்றங்கள், மானுடத்துக்கு எதிரான குற்றங்கள் என்பதையும் விட, அவை இன அழிப்பு என்பதே எமது நிலைப் பாடாகும். இன அழிப்பு இடம் பெற்றுள்ளது என நிலை நாட்டுவதன் மூலம்தான் பாதிக்கப் பட்ட மக்களுக்கு நீதி வழங்க முடியும். இப்பணியினை முன்னெடுத்துச் செல்வதற்காக நாங்கள் ஒரு நிபுணர் குழுவை உருவாக்கியுள்ளோம். தமிழ் இனத்தை முற்றான அழிவிலிருந்து காப்பாற்றுவதற்கு சுதந்திர தமிழீழமே வழி என நாங்கள் நம்புகின்றோம்.
அத்தகைய நிலை உருவாகும் வரை எம் முன்னால் உள்ள வினா ஒன்றே ஒன்றுதான். ‘அநாவசியமாக ஒரு உயிர் இழக்கப்படுவது கூடத் தவிர்க்கப் படக்கூடியது என்ற உண்மையை உலக சமூகம் உணரும்வரை இன்னும் எத்தனை தடவைகள் இத்தகைய பாடம் கற்றுக் கொள்ளும் அனுபவங்களூடாகப் பயணித்தாக வேண்டும்?’ என்பதே எமது வினாவாகும்.

Will Sri Lanka Learn a Lesson Today? Transnational Government of Tamil Eelam
Today the 19th session of the UN Human Rights Council (UNHRC) adopted a resolution pertaining inter alia to the international crimes committed by the politico military establishment of the Government of Sri Lanka in its war against the Tamils. The Transnational Government of Tamil Eelam (TGTE) has always maintained that only an independent international inquiry will bring accountability and justice to the Tamils as victims. What has been adopted today is a watered-down version of the original US sponsored resolution calling for an independent inquiry and implementation of LLRC recommendations.
We welcome the fact that the international community that once congratulated the feat of the Sri Lankan Army of shooting tens of thousands of innocent civilians, including children, women, the sick and the aged, has now found time to sit down, sift through the evidence, and then pose the question to Sri Lanka if it would mind re-examining some of its core contentions. The Government of Sri Lanka used every trick in the book to defeat this resolution, in itself a lukewarm and insufficient resolution as a response to the enormous amount atrocities that were committed by the Sri Lankan Government forces in the first months of 2009.
However, as the votes have now turned out, we see that it is not the resolution, but the Government of Sri Lanka that has been defeated. We can say in a loud and clear voice that this first defeat of them is not going to be their last one. We are confident that Government of Sri Lanka will face many defeats in the months and years to come. For this, the international community, sensitized as it is to the belligerence and intractability of the Sri Lankan State, should stay focused on the everyday events in that island and the progress in terms of accountability and delivery of justice to the long suffering Tamil people.
We also thank the many international civil society organizations and media that are working hard to keep the issue in the international altar and for their quest for justice to Tamils. We thank our brethren in Tamil Nadu who provided a determined effort irrespective of political affiliations.
Their united rally behind the intelligent, compassionate, and courageous leadership of Chief Minister Selvi Jeyalalitha, demonstrated to the world that the struggle for Tamil Eelam is now carried not by Eelam Tamils alone, but by the world Tamils as a whole. The struggle imbued with justice and morality of the 60 million Tamils will never be in vain.
Over the past several weeks, the Tamil Diaspora, Tamil civil society and the Tamil political leadership in the homeland, acted in unison recognizing the significance of the monumental opportunity that came our way via the 19th session of the UNHRC. We envision more such unified action in the months and years to come. We call upon all the Tamil entities to discuss and strategize towards our common destination – an independent and sovereign state of Tamil Eelam.
We wish to draw attention to the fact that at the height of atrocities taking place in Libya, immediate calls were being made to bring the responsible perpetrators for trial. The ongoing situation in Syria is that there are human rights violations and calls for accountability of those responsible. The basic principle of human rights that all human lives have equal protection and are of equal value must be upheld at all times and not abused for the sake of political expedience.
The atrocities in Libya and Syria pale into insignificance in the face of the enormity of the genocide of the Tamils in Sri Lanka and the continued and systematic repression of Tamils being practiced today by the Government of Sri Lanka today. It is because of these factors, coupled with the lack of polityical will in the island of Sri Lanka as pointed out by the UNSG Expert Panel to meet out justice domestically, that the TGTE still holds the view that the outcome at the HRC regarding Sri Lanka as insufficient. We will also employ various international and domestic forums in different countries to have an international investigation commenced.
TGTE declared the year 2012 as a year for International investigation. TGTE Parliament also passed a resolution calling for an international protection mechanism for our brothers and sisters in the island of Sri Lanka. We are exploring various modalities of an International protection mechanism. We believe what happened in Sri Lanka in 2009 were not just war crimes and crimes against humanity but an act of genocide. Establishing the fact that there has been Genocide is necessary to deliver justice for the victims. We have formed a panel of experts to take this task forward. We belive Tamil’s physical survival can only be ensured in an independent Tamil Eelam. Today, and until then, the question that begs an answer is “How many times will the lessons will have to be learnt and re-learnt before the international community realizes one more life lost is one too many!”
